1.These Terms and Conditions apply to all applicants of the “Dream Team 15” Program ("Program") and are valid for the entire duration of the Program, which includes (but is not limited to) the application, selection trials, selection, transportation and visit to Australia and the entire training camp in Australia conducted during the course of the Program organised by Access India (ABN 98 994 451 090) of North Adelaide, South Australia ("Organiser").
Entry and participation in this Program will be deemed as an unconditional and an unequivocal acceptance of these Terms, including any modifications, revisions and amendments thereto. The decisions made in respect of any process during the Program (including but not limited to, selection) shall be final and binding on the Participants in all matters related to the Program.
These Terms may be modified at any time and from time to time without prior/public notice to any applicant by posting the applicable or modified terms and conditions on the Promotion Website, and upon that posting, shall be immediately effective, with all rights reserved to cancel or terminate the Program at any stage, including without notice and in respect of which no rights to any claim or action on the part of any applicant shall arise. Successfully entering the Program and attending the Cricket training camp in Australia is subject to all requirements set forth herein.
a. Applicants will be male who are citizens of India and born between 1 January 1997 - 31 December 1999.They should not be professional cricketers.
b.The date of birth of each applicant must be certified by the school in the school nomination letter as well as by the parents / guardian in the consent letter.
c.The applicant should have a valid passport at the time of application or arrange to get a passport before 15 November 2014. If the applicant is selected and does not have a passport by 15 November 2014, the Organiser reserves the right to cancel the selection with the option to offer the opportunity to waitlist the applicant.
d.The applicant must not have any criminal record and should have no criminal proceedings (or charges) pending in any court or tribunal, in India or world-wide at the time of application, or during any part of the Program. The applicant must not be restrained from participating in the Program, by any law, judgment, ruling, affiliation, or medical opinion, either currently in effect or coming into force during the schedule of the Program.
e.The applicant must not have any illness or health condition that would expose either the participant, or any other participants or the Organiser of the event, to any health or safety risk.
f.The applicant should not be under any management contract, recording contract, modelling contract, agency representation contract, merchandising contract, or any similar contract, in India or world- wide, either directly or as part of any association or relationship at the time of application. The applicant agrees that they will not enter into any management contract, recording contract, modelling contract, agency representation contract, merchandising contract, or any similar contract, in India or world- wide, either directly or as part of any association or relationship, during the entire schedule of the Program, without the express written permission of the Organiser of the Program.
a. All applicants will submit their application along with the School Nomination letter and Parents / Guardian consent letter by 30 September 2014. The applications can be submitted via:

b. All applications will be reviewed and a total of 60 Applicants from each city will be shortlisted for the Pre Australia Selection camps in New Delhi and Mumbai. Based on the number of applications received, the Organiser reserves the right to modify the numbers shortlisted for Pre Australia Selection camps without assigning any reasons thereafter. Selected applicants will be informed of their selection to attend the camp via email and telephone by 15 October 2014.
c. Applicants will attend Pre Australia Selection camps in Mumbai and Delhi at their cost. No travel cost shall be paid for participation in the selection camps. No liability or responsibility for lost stolen or damaged personal items during the Program falls to the Organiser of the Program.
d. Post selection camps in Delhi and Mumbai, a list of 15 selected participants and a list of 15 wait listed participants will be drawn out by 15 November 2014 and selected participants will be informed of their status via email and telephone.
e. All travel costs will be met for those selected participants of the “Dream Team 15” Program (including cricket gear, international air tickets to Adelaide, local boarding and lodging, visa and insurance costs). Participants are responsible for incidental costs and personal expenses. Suitable chaperones will be sent from India to accompany participants for the entire trip. No liability or responsibility falls to the Organiser of the Program for any personal items that are lost, stolen or damaged, in respect of which participants should take out their own insurance. Tax payable in India for attending this is Program, if applicable, is the responsibility of the participant/applicant and Parents / Guardians of the participants/applicants.
f. The Organiser of the Program reserves all rights to select in their sole and absolute discretion all final participants and those on the waiting list. That decision shall be final and binding on all participants/applicants.
g. In case any one or more of the 15 selected participants are unable to provide their consent, or are otherwise unable to go to Australia as per the notified deadline, that participant’s offer to participate will be cancelled, and re-issued to another participant selected from the waitlist.
h. The Organiser of the Program will not be responsible for any permanent or temporary injuries, disabilities, accidents or health issues caused directly or indirectly suffered by a participant or a third party as a consequence of any act or omission by a participant during the entire duration of the Program. The parents/guardians agree to indemnify and hold harmless all persons and entities associated with the Program against all costs and claims for medical treatment, health issues or injuries of such injured participant or third party as the case may be.
i. During the entire Program, the parents/guardians hereby authorize the Organiser of the Program to act on the their behalf according to the best judgment of the Organiser of the Program in any emergency with regard to the participant requiring medical attention, and the parents/guardian hereby waives any and all claims, expenses and/or damages for personal injury, illness and/or property damage that the guardian or the participant may have against the Organiser of the Program, their respective directors, officers, agents, employees, contractors, representatives and any volunteers, wholly.
j. Participants are required to wear the appropriate protective cricket equipment at all times whilst participating in the selection trials, training or cricket games held as part of the Program. Parents/guardian waives any and all claims, expenses and / or damages for personal injury that the guardian or the participant may have against the Organiser of the Program as a result of not wearing the appropriate cricket gear.
k. The Organiser of the Program accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, documents, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise.
The Organiser of the Program shall not be liable for any consequences of user error including (without limitation) cost incurred and take no responsibility for any lost, corrupted, damaged, tainted, ambiguous, obscure applications sent by the applicants.
In addition no obligation arises on the part of the Organisers of the Program to consider applications that are lost, delayed, damaged, defaced, tainted, illegible or corrupted on account of the fault or deficiency of the Postal Services, nor obliged to inform applicant of the disentitlement.
l. If an applicant/participant is dissatisfied with the Program or the Program or Terms and Conditions, the applicant/participant’s sole and exclusive remedy is to not participate in the Program.
a. The applicants/participants and their Parents / Guardians of the undertake and irrevocably and unconditionally permit the applicants/participants and their Parents / Guardians of the undertake and irrevocably and unconditionally permit the Organiser of the Program to cover the Promotion through various media including newspapers, radio, television including news and other channels, internet, point of sale materials, and shall not raise any objection, protest or demur whatsoever to such coverage and shall irrevocably consent to the reproduction of photographs or other visual images of the applicant/participants. Further, the Applicants and Parents / Guardians of the applicants also understand and agree that their responses may be publicised as part of this Promotion.
The applicants/participants must, at the request of the Organiser of the Program participate in all promotional activity(such as publicity and photography) surrounding the Program, free of charge, and they irrevocably consent to the use of their name and image in all promotional materials.
The applicants/participants and their Parents / Guardians irrevocably and unconditionally permit the Organiser of the Program to use, in perpetuity, without the requirement of any consideration, intimation, notice or approval, the images, photographs, video footage, audio footage, portraits, caricatures, silhouette, voice, video and/or audio recordings and other visual representation and write-ups, taken, shot or created at any-time during the Program.
The said images, photographs, video footage, audio footage, portraits, caricatures, silhouette, voice, video and/or audio recordings and other visual representation and write-ups may be used for any commercial, non- commercial, internal or other purposes, by the Organiser of the Program its associate or related companies, entities or firms, or other third party individuals or entities to the extent authorized by the Organiser of the Program.
b. The Organiser of the Program shall not be liable to the parents / guardian or the participant/applicant under any circumstances in respect of any claim for loss of opportunity on the part of the participant/applicant to enhance the participant/applicant's reputation;
c. The parents / guardians will fully indemnify the Organiser of the Program including their respective Directors, Employees, Officers and Agents against all actions, losses, claims, damages, costs and expenses of whatever nature arising directly or indirectly from any breach of the Terms and Conditions.
All right, title and interest, including but not limited to the Intellectual Property Rights, in the promotional material(s), and in any and all responses received, or other materials created during or for the Program, or during the trip as a part of the Program or otherwise, shall vest solely and exclusively with the Organiser of the Program at all times, who shall be entitled to use the responses received or any information in connection with the entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and or payment to the applicant/participant.
All material submitted in connection with the Program (whether written, audio, electronic or visual form, or a combination of those) or any images, photographs, video footage, audio footage, portraits, caricatures, silhouette, voice,video and/or audio recordings and other visual representation taken of Applicants, during the Program at Australia or otherwise during the trip or any part of the Program, are assigned to the Organiser of the Program upon submission and become the property of the Organiser of the Program exclusively. The Organiser of the Program may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of the Organiser of the Program.
a. The courts of competent jurisdiction of South Australia shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with the Program.
b. Participation in the Program is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation, this clause.
c. Further all issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions or the rights and obligations of the applicants/participants and/or Organiser of the Program and/or partners of this Program shall be governed and construed in accordance with the laws of the Government of South Australia.
